TERMS OF SERVICE

Scope of Services
Mathis Prime Media ("Agency") offers traditional media buying services, including broadcast television and terrestrial radio planning, negotiation, and consultation. Services are delivered under three tiers:

Signal Starter – Free negotiation for one station.

Market Mover – One-time $499 fee, negotiating with up to three stations and Nielsen-anchored analysis.

Dominant Signal – One-time $999 fee, negotiation with up to five stations, deep AI and Nielsen-backed strategy.

Eligibility & Engagement
Services are available to legal individuals or entities with intent to purchase advertising within their designated market area (DMA). Use of services implies agreement to these Terms.

Booking & Payment Terms

Market Mover and Dominant Signal plans require full payment at the time of booking.

The Signal Starter plan is free of charge; Agency compensation is derived from standard 15% commission paid by stations.

No additional fees unless expressly agreed in writing.

Cancellation & Refund Policy
Clients may cancel paid engagements prior to initiation of strategic or negotiated services for a full refund. Cancellations after commencement of work are non-refundable. Requests must be submitted via email to

Intellectual Property Rights
All materials, tools, methodologies, and analyses provided by Agency remain the sole property of Mathis Prime Media. Clients are granted a non-exclusive license to use deliverables for internal media planning only.

Limitation of Liability

Agency provides services “as-is” and disclaims all warranties, expressed or implied, including guarantee of results.

Agency’s total liability to the client shall not exceed the total fees paid under these Terms.

Agency is not liable for station performance, broadcast errors, or market fluctuations.

Indemnification
Client agrees to indemnify and hold harmless Agency and its affiliates from claims, losses, or liabilities arising from client’s advertising materials or actions that violate third-party rights or regulations.

Governing Law & Arbitration
These Terms are governed by the laws of the State of Texas without regard to conflict-of-law principles. Disputes will be resolved by binding arbitration under the Texas General Arbitration Act.

Amendments
Agency may update these Terms. Clients receiving paid services will be notified of material changes. Continued use after notification implies acceptance.

Severability
If any provision is deemed unenforceable, remaining provisions remain in full effect.
